Minnesota Statues 524.2-101 through 524.3-613
Minnesota Statutes 524.2-101 through 524.3-613 govern the appointment of a personal representative of an estate. Bonds are not mandated by statute; a judge may set it, but may also waive the requirement if the bond requirement is specifically waived in the will or if the beneficiaries under the will sign written bond waivers. In an intestate proceeding, in which the decedent died without a will, the setting of a bond is again at the discretion of the judge or probate referee.
